Relationship between AI and the law can be tricky
Artificial Intelligence (AI) is billed as a labour- and time-saving way to analyse, interpret and create information.
It’s supposed to be an incredible, life-changing advance in all we do.
When AI and the law get together, what could go wrong?
Actually, plenty.
The supporters of AI say it can provide a summary of emails received, documents to be read, contracts to be understood.
Our experience of AI as lawyers is quite different.
We have seen:
- Emails summarised incorrectly – where the meaning provided by AI is completely wrong.
- Legislation quoted incorrectly – sometimes years out of date.
- Cases described incorrectly – sometimes even made up.
- Contracts summarised in completely erroneous ways.
We never rely on AI in our practice.
Clients have sent us emails which are clearly generated by AI. They are often lengthy, repetitive and off topic.
We have had clients provide us with AI-generated summaries of retirement village contracts (one of our specialist areas of practice) that are so wrong that they do more harm than good.
Clients have been given misinformation through AI, and decisions based on this can be life changing – in a bad way.
In some cases, lawyers have used AI to create submissions to the court.
As well as quoting the wrong acts or sections, in some extreme cases the AI has simply made up cases in support of the argument being pressed.
The courts have taken an extremely hard line in these circumstances.
They have taken the lawyers using AI, which has set out false or misleading information including made-up cases, to the Legal Services Commission for disciplinary action.
We never use AI to interpret documents or communications.
We are old school. We read it.
